Terms and Conditions

By submitting this order form (“Agreement”) to Dostal Dental Laboratory (“the Lab”), the customer (“you”) agrees to abide by all terms and conditions listed below.

PAYMENTS:

All account balances are payable in full within 10 days from the statement date. Accounts not paid within the stated terms will be subject to C.O.D. status and a late charge of 2% of unpaid balance. All cases remain the property of the Lab until the account balance is paid in full. All disputes arising out of or relating to the agreement, or the work performed shall be governed in all respect by the laws of California without regard to its conflicts of law provisions, with venue in Los Angeles County, with prevailing party to receive attorney’s fees, court costs and all other expenses, in addition to any other relief to which the prevailing party may be entitled.

  1. CASE PREPARATION & INFECTION CONTROL:

You must thoroughly disinfect and clean off all blood and saliva from all materials used in the mouth before sending them to the Lab. You must also disinfect all these items after they are returned to you by the Lab before you place them in the patient’s mouth.

  1. CONDITIONS OF REPAIR OR REPLACEMENT OF DEVICES AND RESTORATIONS:
  • Prosthesis insertion or cementation must have been performed by a licensed, practicing dentist.
  • Devices and restorations must be returned to the Lab with models and original impressions.
  • The warranty does not cover breakage resulting from accident or misuse.
  1. REMAKES:
  • a) If the case is found to be defective, a clearly written explanation of the non-conformance shall be communicated to the Lab within a reasonable time (not to exceed 10 business days after delivery date).
  • b) The cause of the non-conformance will be assessed by the Lab, based on the written explanation sent by you, and reviewed by the Lab. If the cause of the non-conforming case cannot be clearly or reasonably identified as due to either the fault of the Lab or the customer, the cost of remaking the case shall be borne equally by you and the Lab.
  • c) A dental appliance that fits the master model poured from the original impression supplied by the dentist and which is created to the specification of the prescription but subsequently has to be remade, is not considered a remake.
  1. LIMITED WARRANTY (REPAIRS, REPLACEMENTS AND REMAKES):
  • Restorations: Up to 1 year from invoice date on most products.
  • Removables: Up to 90 days from invoice date.
  • Implants & Veneers: No Warranty.
  1. DELIVERY PERIODS AND WORKING SCHEDULE:
  • a) Please allow the full working time on each type of product. Working times do not include weekends, holidays, and shipping times. All Rush cases must be pre-scheduled by calling customer service before the case is shipped. Time of pick-up and delivery may affect turnaround time. To Pre-Schedule your Rush cases please call 1.818.821.8887. Rush Fees May Apply.
  • b) Unless otherwise agreed by both parties (Dostal Dental Laboratory and Customer), in writing, delivery periods specified in the RX form shall be considered approximate. When scheduling patient appointments, please anticipate that there may be shipping delays outside of our control.

• c) Multiple units (5+) and combination cases for full-mouth restorations require more time. Contact Dostal Dental Lab so we can evaluate and provide you with a delivery date.
